Employment Fees

Employment issues can be complex and lengthy to resolve and the total cost can depend on a wide range factors. Below you can find out more about the fees we charge and the people who will fight relentlessly in your corner to achieve the best possible results for you and your business.

Our fees

The costs outlined below only apply to cases of wrongful or unfair dismissal. However, our experts can support you with every aspect of employment law, and we are happy to discuss fees with you for other claims, such as discrimination, on a case-by-case basis. Sometimes claims of this nature and employment claims may be covered by an insurance policy. If you are interested, we can talk more about that too.

Type of claimComplexity levelOur estimated fees (not including VAT)*
Wrongful dismissalLow£5,000 to £8,000
Unfair dismissalLow£8,000 to £14,000
Unfair dismissalModerate£10,000 to £17,500
Unfair dismissalHigh£15,000 to £30,000

*On the basis that the claim is defended in full to a final hearing

The fee estimate includes our fees for instructing Counsel and attending alongside Counsel. Prices do not include the cost of representation at the final hearing or any hearing throughout the tribunal process if Counsel conducts the hearing. Where the instruction of Counsel is necessary, we will provide you with an estimate of Counsel’s fees to approve. These could be £650-£2,500 per day plus VAT (including preparation), depending on the complexity of the claim and the seniority of Counsel. The hearing could be from half a day to a week or more (in complex claims).

Factors that could make a case more complex:

  • If it is necessary to make or defend applications, amend claims or provide further information about an existing claim
  • Defending claims that are brought by litigants in person
  • Making or defending a costs application
  • Complex preliminary issues such as whether the claimant is subject to any protected characteristics, e.g. disability, race etc. (if the parties do not agree this)
  • The number of witnesses and documents
  • If it is an automatic unfair dismissal claim e.g. if an employee claims to have been dismissed after blowing the whistle on their employer
  • Allegations of discrimination linked to the dismissal

What is included in these fees?

The fees set out above cover all of the work in relation to key stages of a claim (if we are instructed from the outset).

Key stages of a claim can include:

  • Taking your initial instructions, reviewing the papers and advising you on merits (this is likely to be revisited throughout the matter and is subject to change)
  • Attempting to resolve disputes before claims are issued and exploring whether a settlement can be reached
  • Preparing the response to the claim
  • Reviewing and advising on the claim and related documents from other parties
  • Considering a schedule of loss and preparing a counter schedule where necessary
  • Preparing for (and attending, if held by phone) a preliminary hearing
  • Exploring settlement and negotiating settlement throughout the process
  • Exchanging documents with the other party
  • Taking witness statements and drafting statements
  • Reviewing and advising on the other party’s witness statements
  • Agreeing a list of issues, a chronology and/or a cast list
  • Preparation for the final hearing, including instructions to Counsel

The stages set out above are an indication only; the fee will reduce if some are not required. If you would like to handle the claim and only take our advice on some of the stages, this can also be arranged.

How long do employment claims take to resolve?

The time it takes from taking your initial instructions to the final resolution of the matter depends mainly on the stage your case is resolved.

We will be able to give you a more accurate timescale once we have more information and as the matter progresses, but here is an estimate of how long your case may take, depending on the circumstances.

  • If a settlement is reached during pre-claim conciliation your case is likely to take 6-8 weeks
  • If your claim proceeds to a final hearing, your case is likely to take 3-6 months for a wrongful dismissal claim and up to 1-2 years for an unfair dismissal claim depending on the complexity
